Salem County Dog Breeder Sued by the State for Selling Sick “Designer” Pups

Mixed-breed puppies are surely fashionable at the moment. While a Yorkie terrier certainly registers on the Richter Scale of cuteness alone, imagine the impact of said Yorkie intentionally cross-bred with the likes of a little white poodle.

It is safe to say that the popularity of these genetically trendy dogs equates to nice chunks of change – so nice, in fact, that South Jersey dog breeder Jessica Durkin is being accused of knowingly selling several designer canines in ill health to unsuspecting buyers.

According to the August 25, 2014 edition of the New Jersey Law Journal, Durkin was named as a Defendant in a lawsuit filed by the New Jersey Division of Consumer Affairs and Attorney General John Hoffman in the Salem County Superior Court on August 14, 2014. The complaint alleges that she sold at least four sick puppies in a mere three month time span extending from late 2012 to early 2013. One of the puppies sold was apparently so sick that it had to be put to sleep. The complaint further alleges that Durkin failed to comply with a panoply of state breeding directives. It is alleged that she violated the New Jersey Consumer Fraud Act and Pet Regulations.

The State is reportedly seeking restitution for aggrieved customers, in addition to attorneys’ fees and civil penalties. The dogs were sold for between $300.00 and $400.00 each.

We will keep you abreast of any developments in the matter.

The Stutzke Law philosophy is that trust is the bedrock of all successful attorney-client relationships. At The offices of Stutzke Law your problems become our problems.
