Family Law

Stutzke Law is proficient in virtually all aspects of family law practice in New Jersey. While we always strive to resolve our cases in an expeditious and cost-efficient manner to the extent possible, we have litigated many high-conflict, contested cases to conclusion. We are well versed in alimony, child support, child custody, parenting time, equitable distribution, domestic violence and other issues attendant to a divorce. We also routinely appear on non-dissolution (“FD” docket) matters, where the parties were not legally married, but have a child together or other outstanding and actionable financial issues arising from their relationship.  In addition to assisting clients actively involved in a dissolution or non-dissolution matter, we prepare pre-nuptial, post-nuptial and cohabitation agreements for clients seeking a degree of certainty as to their financial future.


Employment Law



We service both employers and employees in our employment law practice. For employees, we review and negotiate favorable severance packages, enforce state and federal anti-discrimination, wage, privacy, and other laws via demand letter and/or litigation, and assist in initial telephone interview and appeals for unemployment insurance benefits. We have also represented public employees in grievance matters, and have appeared before the Public Employment Relations Commission (PERC) and obtained disability benefits for clients through the Police and Fireman’s Retirement System (PFRS).  For employers, we draft employee handbooks to protect your business interests, establish lawful rules and regulations for the workplace, and maintain compliance with all local, state and federal mandates. We also consult with employers and offer general business advice in terms of their hiring, firing and other personnel practices, as well as draft appropriate hiring and separation agreements.


Business Litigation



While similar to the practice of employment law, the field of business litigation typically involves separate issues such as covenants not to compete, breach of the employee duty of loyalty, tortious interference with contract, and the disclosure of trade secrets and other proprietary information. We represent employers, subcontractors and employees in this capacity, whether in terms of negotiations or Court defense.




Real Estate



We represent clients in the purchase and sale of residential properties. For most people, these transactions are the biggest financial exchanges that they will ever make. It is thus imperative that you have the guidance and benefit of experienced counsel on your side. We work with only the best realtors, title companies, lenders and inspectors towards ensuring that your real estate transaction will run as smoothly as possible.



Municipal Court



The Municipal Courts in New Jersey entertain traffic violations and disorderly persons offenses, in addition to other minor criminal matters. Stutzke Law has appeared in several Municipal Courts throughout the state, frequently negotiating optimal plea bargains and/or dismissals of these minor infractions.




Estate Planning



We understand the importance and need of security as a person reaches various milestones in life, i.e., getting married and having children and/or grandchildren, or enters the advanced stages of life and/or illness. At Stutzke Law, we prepare Last Wills and Testaments, Powers of Attorney, and Advanced Health Care Directives for our clients in order to assuage their concerns so that they can move forward knowing that their financial and medical wishes and desires will be followed upon their passing.






Our office also files Verified Complaints for Guardianship in the County Surrogate’s Courts on behalf of parents whose children are or are about to turn eighteen years of age and who are receiving services from the State based on their disability. We fully understand the sensitivity involved in these private family matters, and endeavor to see these cases to conclusion as expeditiously as possible.






Stutzke Law also assists its clients in matters such as residential property tax appeals, landlord/tenant disputes, small claims (civil claims under $3,000.00) and special civil part matters (civil claims under $15,000.00), legal name changes, and property tax appeals.
